摘要：

数字贸易已成为全球经济发展“新引擎”，上海自贸试验区应率先全方位对接《全面与进步跨太平洋伙伴关系协定》（Comprehensive and Progressive Agreement for Trans-Pacific Partnership，以下简称“CPTPP”）、《数字经济伙伴关系协定》（Digital Economy Partnership Agreement，以下简称“DEPA”）等国际高标准数字贸易规则，以更高水平压力测试推进制度型开放，为数字贸易规则创新和制度建设提供更多“上海方案”。目前上海自贸试验区在对接CPTPP、DEPA上总体仍处于探索阶段，在对接的广度和深度方面尚有所欠缺。对此，应加快建立安全合规、便利有序的数据跨境流动机制，持续深化数据技术应用创新，建立高效的数据开放共享机制，建立和完善数字贸易领域的风险预警和防控机制，构建适应国际规则的争端解决渠道，出台一系列支持和指导中小企业开展跨境数字贸易的政策和机制。

Abstract:

Digital trade has become a new engine for global development. Shanghai Pilot Free Trade Zone should take the lead in fully integrating with international high standard digital trade rules such as CPTPP and DEPA，promoting institutional openness through higher level stress testing，and providing more “Shanghai Propositions” for digital trade rule innovation and institutional construction. At present，Shanghai Pilot Free Trade Zone is still in the exploratory stage of integrating with CPTPP and DEPA，and there still exist a lack of breadth and depth. We should accelerate the construction of a secure，compliant，convenient and orderly cross-border data flow mechanism，continuously deepen innovation in data technology applications，establish an efficient data openness and sharing mechanism，establish and improve risk warning and prevention mechanisms in the field of digital trade，and build dispute resolution channels that adapt to international rules，develop and introduce a series of policies and mechanisms to support and guide small and medium-sized enterprises in conducting cross-border digital trade.
