Rights Allocation Rules of Personal Digital Archive Heritage in the Digital Economy Era

Abstract:

The rights allocation rules for personal digital archive heritage serve as a response to the transformation of archival governance in the digital economy era. An examination of the challenges in constructing these rules reveals three key dilemmasthe ambiguity of critical legal concepts hinders the clarification of rule elementsthe diversity of rights allocation scenarios complicates the establishment of a coherent rule systemand the failure of ownership order safeguards restricts the long-term development of these rules. Based on thisit is proposed to improve the basic rulesoperational detailsand supporting safeguards for the rights allocation of personal digital archive heritage in the digital economy erabalancing the needs of protecting archival personality rightsdeveloping archival data resourcesand promoting collaborative governance of archival sharingso as to establish a set of rights allocation rules for personal digital archive heritage that adapts to the digital economy era.
