Abstract:
The rights allocation rules for personal digital archive heritage serve as a response to the transformation of archival governance in the digital economy era. An examination of the challenges in constructing these rules reveals three key dilemmas:the ambiguity of critical legal concepts hinders the clarification of rule elements,the diversity of rights allocation scenarios complicates the establishment of a coherent rule system,and the failure of ownership order safeguards restricts the long-term development of these rules. Based on this,it is proposed to improve the basic rules,operational details,and supporting safeguards for the rights allocation of personal digital archive heritage in the digital economy era,balancing the needs of protecting archival personality rights,developing archival data resources,and promoting collaborative governance of archival sharing,so as to establish a set of rights allocation rules for personal digital archive heritage that adapts to the digital economy era.
